The laws and regulations governing bank use of brokered deposits should be updated to reflect current deposit behaviors and bank funding models and take a holistic approach to modern bank liquidity risks and practices. Brokered deposit regulations should be tailored to the bespoke characteristics and risks of specific funding arrangements and allow institutions that become less than “well capitalized” to gradually reduce their reliance on brokered deposits over time.
